Despite the growth of the surrogacy market and its social approval in Russia, the legal regulation remains fragmented and fails to account for the risks of women's exploitation and the commodification of childbirth. Using formal-legal and historical-legal methods, along with an analysis of current legislation, the article argues that the liberal interpretation of bodily rights leads to the commodification of the female body and the objectification of the child, while freedom of contract under conditions of socio-economic inequality creates risks for surrogate mothers. This approach creates preconditions for the objectification of women and children and the diminution of their dignity. Thus, it is necessary to legally establish boundaries for interference with personal inviolability to protect surrogate mothers from unfair contracts.
