In this paper, some legal problems of the current migration legislation are considered. Some legal state mechanisms that are determinants of migration crime are analyzed, and some legal solutions to this problem are proposed.
In the article, the author explores the relationship in criminal law of such concepts as torment» and «torture». The work examines the provisions of criminal law regarding torture, and analyzes the problem of the concepts of «torture» and «torment».
The rapid development of artificial intelligence systems poses fundamentally new challenges for law, since traditional doctrines and norms designed for human actions often do not work in situations where an autonomous algorithm plays a key role. For example, in the field of copyright, a paradox arises: the usual mechanisms for protecting the results of creativity are difficult if the «creator» is not a person, but a self-learning program. Artificial intelligence acts as a source of risks, affecting both property rights and interests, as well as the fundamental rights and freedoms of citizens. In these circumstances, the question becomes particularly acute: how is the existing legislation – civil and criminal – able to respond to the challenges associated with the use of AI tools, and what changes are needed to adequately protect rights in the high-tech era.
The article examines the interaction between public and private law in the process of bringing individuals to criminal responsibility. It draws attention to the recent trend of increasing the severity of criminal penalties for individuals who have committed certain types of crimes, which has led to the infringement of the private legal interests of law-abiding citizens. The article also emphasizes the need to ensure a balance between public and private interests in criminal proceedings
The article is devoted to a comprehensive analysis of recidivism. A study of recidivism based on the Criminal Code of the Russian Federation and judicial practice is being conducted. It is concluded that there is an increased public danger of people committing recidivism and that the punishment for them will be increased as the main legal consequence.
