Criminal procedure law requires ensuring a fair trial, which includes the opportunity for the accused and his defense attorney to familiarize themselves with the case materials. This aspect plays a key role in implementing the principle of adversarial proceedings and guaranteeing the right to defense. However, in practice, various difficulties arise related to the time limitation allotted for familiarization with the case materials. This article analyzes the theoretical and practical aspects of this problem and suggests possible solutions to overcome it.
This article examines the challenging aspects of investigating serial sexual murders in contemporary Russian law enforcement practice. It examines the legal classification of these crimes, the difficulties in identifying seriality, and the specific aspects of evidentiary proceedings. The authors identify key organizational and methodological shortcomings that hinder effective investigations, including the lack of regulatory criteria for seriality, insufficient coordination between agencies, and limited preliminary investigation timelines. Particular attention is paid to modern forensic capabilities, including genomic registration, digital technologies, artificial intelligence, and complex forensic examinations.
The article is devoted to rehabilitation in criminal proceedings as a comprehensive legal institution aimed at restoring the rights, freedoms and legitimate interests of persons who have been unlawfully or unreasonably subjected to criminal prosecution. It is concluded that the legal nature of rehabilitation lies in its dual nature: on the one hand, it is a guarantee of constitutional human rights enshrined in the Basic Law of the State, and on the other, it acts as a procedural mechanism that is regulated by the norms of criminal procedure law.
